ACCEPTABLE USE POLICY

1. Purpose

This Acceptable Use Policy sets out the terms under which you may access the services provided by MuchBetter Business (the “Services”). It applies as soon as you access and/or use our Services. Prohibited or high risk / restricted activities and jurisdictions are subject to change and may be based on regulatory obligations, our risk appetite or the risk appetite of our banking partners.

2. Policy

Prohibited Business Types, Activities and Jurisdictions – for, in and related to which we do not provide, and you may not use our Services.

(a) Prohibited Business Types

  • Illegal drugs;
  • Illegal downloads;
  • Illegal gambling;
  • Shell Banks;
  • Goods or services infringing Intellectual Property Rights of a third party;
  • firearms;
  • Ponzi schemes or similar fraudulent investment operations; or
  • Transactions involving shell companies
  • Any goods or services prohibited or restricted by Applicable Law or regulations for the user or MuchBetter Business.

Prohibited Activities

  • Breaches or intent to breach any applicable law, regulation, sanctions or guideline. Please note that the Account Holder is solely responsible for ensuring it does not contravene any legislation or sanction etc, which is applicable to it and must not use our Services in breach of any such prohibition or obligation.
  • Unlawful or fraudulent purposes or effects.
  • Harm, exploit, or attempt to harm others, including minors or vulnerable persons.
  • Abusive, incites hate/violence, or non-compliant with content standards.
  • Misleading or illicit advertising, promotional material, or spam.
  • Harmful programs like viruses, spyware, or similar computer code.
  • Illegal evasion of applicable taxes, levies, or duties.
  • Likely to result in complaints, disputes, reversals, chargebacks, or other liability.
  • Unapproved purposes requiring approval.

 

We do not provide our Services to businesses that engage in, or support transactions which involve, the following types of activities:

  • illegal activities
  • unlicensed activities where a licence is required
  • unregulated activities, when such activities are regulated
  • unauthorized financial services
  • unregistered investment schemes
  • Other categories outside of our risk appetite in accordance with our internal policies, our banking partners’ policies or the policies of participants in our payment network.

You also agree:

  • not to copy or use any part of our Services in contravention of the provisions of our MBB Agreement; and
  • not to access without authority, interfere with, damage or disrupt:
    • any part of our Services;
    • any equipment or network on which our Website is hosted or stored;
    • any software used in the provision of our Services; or
    • any equipment or network or software owned or used by any third party

  • foreign missions
  • gambling related business (including online gambling)
  • high value dealers/high cash turnover
  • import/export business

3. Suspension and Termination

We alone will determine whether there has been a breach of this Acceptable Use Policy through your use of our Services.

We take breach of this policy seriously and upon your breach, may take the following actions:

  • decide and implement the immediate, temporary or permanent withdrawal of your right to use our Services.
  • suspend or cancel your payment orders and take such other actions as we consider necessary.
  • freeze your funds and/or accounts while investigations are ongoing.
  • remove any posting or material uploaded by you.
  • return funds to the sender (including to cooperate with a fund recall request from one of our banking partners).
  • issue a written warning.
  • take legal action against you for damages and/or for reimbursement of all costs incurred from your breach on an “all expenses” basis; and/or
  • report and disclose relevant information to applicable law enforcement authorities.

 

4. Changes to the MuchBetter Business Acceptable Use Policy

We may revise this Acceptable Use Policy from time to time to reflect a change of regulatory requirements or a change of our or our partners’ risk appetite by updating this page. Such changes may affect the services we are currently providing you. You are encouraged to review this policy periodically and regularly to avoid any interruption of your services, as this Acceptable Use Policy, as amended from time to time, is legally binding on you.
