Card and Wearables Terms & Conditions UK 

These terms are a supplement to, and must be read together with, your Customer Agreement (available here), which sets out the terms in relation to your MuchBetter Account. Some capitalised terms have specific definitions in section 1 or are defined in your Customer Agreement.

You acknowledge and accept that by ordering a Card or Wearable (as defined below), you agree to abide by the following terms as amended from time to time (“Card and Wearables Terms”) concerning your use of your Card(s) or Wearable(s). 1. DEFINITIONS
1.1 In these Customer Terms, the following words have the meaning set out beside them:

“Account” means your Account with MuchBetter Service which holds electronic money and, where applicable, which your Card(s) is linked to;

“Account ID Information” means any and all of the following pieces of information: your Card details (Card number, expiry date and CVV code), your PIN, information you use to log in to your Account, your secure identification number and other Account credentials and information specific to your Account;

Account Violations” has the meaning set out in section 4;

“Authorised User” means a person authorised to use the MuchBetter Service, after meeting all eligibility requirements set out in these Customer Terms;

“Authorised User Site” means the mobile application, the App or website accessed by Authorised Users using their Account ID Information, where Authorised Users can view their transaction history, top up funds into their Account and make other Transactions;

“Business Day” means a day other than a Saturday, Sunday or a public holiday in the UK when financial institutions in the UK are open for business;

“Card” means MuchBetter Prepaid Card;

“Customer Contact Centre” can be contacted by visiting Help.

“Top up” means the crediting of funds to your Account by purchasing electronic money;

“Merchant” means any commercial or business entity that (i) accepts cards displaying the MasterCard® acceptance symbol as payment (where a Card Transaction is concerned) or (ii) is validly registered with MIR Limited UK Ltd, Company number 10417552, or any of the MIR Group companies, to accept Transactions from your Account;

“MIR”, “MuchBetter”, “we”, “our”, “us” means MIR Limited UK Ltd, Company number 10417552, with its registered office located at  Berkeley Square House, 2nd Floor, London, England, W1J 6BD, United Kingdom;

“MIR Exchange Rate” means the exchange rate used by us on all currency exchange transactions as published on our Website and which may be amended by us from time to time in accordance with these Customer Terms;

“MIR Group” means Rtekk Holdings Limited (incorporated in the Isle of Man with company number 018684V), its subsidiaries, holding companies and associated companies;

“Payment” means any of the following: (i) any payment made using your Card; (ii) the debiting of an amount of electronic money from your Account and the concurrent crediting of such amount to a Merchant account, or another MuchBetter customer account, as designated by you (including by way of Subscription Billing); or (iii) the crediting of an amount of electronic money to your Account and the concurrent debiting of a Merchant account, or another MuchBetter customer account;

“Payment Order” means a request from you to us for us to execute one or more Payments;

“PIN” means the personal identification number which we issue to be used with your Card and access to the MuchBetter Service;

“Prohibited Transaction” means any of the following types of transactions: (i) drugs; (ii) pornographic content or services; (iii) illegal downloads; (iv) illegal gambling; (v) goods or services infringing Intellectual Property Rights of anyone, including a third party; (vi) firearms; (vii) Ponzi schemes or similar fraudulent investment operations; or (viii) any goods or services prohibited by applicable law and regulations to the user, user’s country or MuchBetter. We reserve the right, in our sole discretion, to add categories of prohibited transactions by adding such categories to these Customer Terms published on the Website;

“Recurring Payments” means an order by an Authorised User to make regular Payments from its Account at specified intervals to an online Merchant; For the avoidance of doubt, a Recurring Payment is a Payment and is subject to any applicable fees which may apply;

“Transaction” means, as the context permits: (i) a Payment; or (ii) a Withdrawal; or (iii) a  top up; and, in each case less any applicable fees;

“Website” means www.muchbetter.com or such other website, mobile application. or the App (“Apps“) through which we may offer the MuchBetter Service, or information related thereto, from time to time;

“Withdrawal” means removing funds from your Account by using your Card at any ATM or by selecting one of the withdrawal methods available to you in your country of residence as set out in the “withdrawal” page of the Authorised Users Site.

2. MuchBetter Service

2.1 MIR Limited UK Ltd (“MIR”, “MuchBetter”, “we”, “our”, “us”) is an authorised electronic money issuer authorised and regulated by the Financial Conduct Authority in the United Kingdom, under FCA Reference Number (FRN) 900704 with its registered office at Signature By Regus, Berkeley Square House, 2nd Floor, London, England, W1J 6BD, United Kingdom.

2.2 All Cards are issued by Paynovate SA incorporated in England and Wales and FCA regulated under reference number 900970 with its head office at Cantersteen 47, 1000 Brussels, Belgium.

3. Applying for Cards and Wearables

3.1 To apply for a Card or Wearable, you will need to verify your account by confirming your identity and place of residence. We may use third parties to obtain and verify this information in accordance with applicable laws, which may also contain credit checks, on our behalf. You agree to us applying reasonable discretion in using and sharing relevant personal data to conduct such identity and verification checks (pursuant to our Privacy Policy).

3.2 There is a minimum amount required in your Account balance before you can order a Card or Wearable.

3.3 We reserve the right to refuse to issue you a Card or Wearable at our sole discretion.

3.4 The prices of Cards and Wearables are available in the fees page on our website.

3.5 If you receive a Card with a signature strip, you must sign it as soon as received.

4. Using your Card or Wearables

4.1 You can use your Card anywhere where Mastercard® is accepted. You can use Wearables wherever contactless payments are accepted. All Transactions made using your Card and Wearable are subject to:
   4.1.1 there are sufficient funds in your Account.
   4.1.2 the terms of the provider of the ATM or relevant financial institution (in addition to these terms).

4.2 We reserve the right to decline any Transaction at our sole discretion. We shall not be liable if a Merchant refuses to accept your Card or Wearable or if we do not authorise a Transaction.

4.3 You must not make a Payment or Withdrawal with your Card or Wearable which exceeds the funds in your Account. If you cause your Account to go into a negative balance, we will take any steps necessary to enforce any actions against you in accordance with the Customer Agreement.

4.4 Using your Card or Wearable with certain Merchants may result in a “hold” on available funds in your Account. This is most common when dealing with car hire companies and hotels. They may estimate the total sum of money you may spend or for which you require authorisation. This may exceed the amount you eventually spend or are charged. This means that some of the funds on your Account may be held for between 30 days to 90 days and you will not be able to spend this sum during this period. We are unable to release such sum without consent from the relevant Merchant, which you must obtain from the Merchant.

5. Card or Wearables Expiry and Damage

5.1 Your Card is valid for the period stated on the Card unless its use is cancelled earlier by you or us in accordance with these Cards and Wearables Terms. Your Wearable is valid for at least four (4) years. Transactions will not be authorised once your Card or Wearable have expired or cancelled.

5.2 Upon expiry of your Card or Wearable, we will request confirmation from you if you’d like a replacement. This will be applicable unless your Accounts have been restricted due to lack of fulfilment of our due diligence requests or the Account has been closed on our end. 5.3 You are not permitted to alter, modify, tamper with your Card or Wearables in any manner which is not consistent with the reasonable and ordinary use of the Card or Wearables. We will not be responsible for any damages which occur as a result of such modifications and tampering, and your Account shall be restricted or closed if the Wearables and/or cards linked to your account have been tampered with.

6. Transactions

6.1 You agree that any use of your Card, card number or PIN constitutes your authorisation and consent to a Transaction. You cannot revoke a Transaction after you have authorised it.

6.2 We may refuse to execute any Transaction under the following circumstances if:
• We reasonably believe that you did not give us a proper instruction.
• We reasonably suspect fraudulent activity.
• We reasonably suspect that these Card and Wearables Terms or the Customer Terms have been violated. We need to do so to comply with the Card scheme rules, applicable laws and regulations, court rulings or instruction by a competent regulatory body.

6.3 Merchants may not be able to authorise a Payment if they cannot obtain online authorisation from us (for example, if they are unable to access the internet).

7. Safety

7.1 You should always keep your Card and Wearables and any security information on them safe and confidential. Never let another party use your Card and Wearable or disclose your PIN, card number or any security information to anyone. Sharing these details can lead to unauthorized access to your Card or Wearable and you will be responsible for Transaction(s) made in these circumstances. MuchBetter will not be liable for any loss arising due to any such unauthorised transaction(s).

7.2 You should observe the security measures as set out in the Customer Agreement regarding your MuchBetter Account.

7.3 Check your transaction history regularly and contact us in the case of unauthorised, incorrect, or misdirected transactions.

7.4 If your Card or Wearable is lost or stolen, if you suspect that someone knows your PIN, or if you think your Card, Card number or PIN may be misused, you must freeze the Card or Wearable in the MuchBetter app, stop using the Card or Wearable and notify us immediately by sending an email to support@muchbetter.com. If you find the card after you have reported it lost, stolen, or misused, you must cut it up and inform support as soon as possible by sending an email to support@muchbetter.com as well.

7.5 If your Card or Wearable is lost or stolen, you can request a replacement. Details of applicable fees are available on our website.

7.6 Disclosure of information to law enforcement authorities: If your Card and/or wearable is used without your permission, or is lost, stolen or if you suspect it may have been misused, we may disclose to law enforcement agencies any information which we reasonably believe may be relevant.

8. Cancellation and Termination

8.1 You may cancel your Card or Wearable by providing us with a written notification (email acceptable to support@muchbetter.com).

8.2 If your card or wearable is not active for a consecutive period of 12 months, we may cancel the Card and Wearable.

8.3 Each party can terminate these Card and Wearable Terms at any time and for any reason subject to the fulfilment of their respective obligations (including payment of all outstanding fees).

8.4 Cancellation and Termination of these Card and Wearables terms or the customer Agreement will terminate your Card or Wearable. We will provide you with a two (2) months’ notice prior to such termination. If the terms become unenforceable or if we are required to terminate them by law or administrative order, we will terminate them and cancel your Card or Wearable without prior notice.

8.5 Notwithstanding the above, we may, at our sole discretion, restrict your access to the Card or Wearable, if we have found, or have reasonable grounds to suspect, that you have committed any Account Violations (as defined in the Customer agreement). Unless prohibited, we will notify you of the termination of your Card or Wearable.

8.6 If a Card or Wearable has been cancelled, for any reason, you will not be able to perform any Transactions. You will be liable to pay all amounts which may have been incurred prior to the cancellation of the card or wearable (including, but not limited to, Transactions, Payments, Fees, etc.).
This obligation shall survive the termination of these Terms.

9. Fees

9.1 Transaction Fees payable by you will be deducted from your Account balance when a Transaction is authorised, and you hereby authorise us to do the same. If your Account balance is insufficient to cover the Fees, we may refuse to execute the payment or suspend any benefit you are receiving. Reversal or chargeback Fees will be deducted when incurred.

9.2 Details on Fees can be found on the fees page of the Website.

9.3 We reserve the right to change the Fees from time to time, in accordance with the provisions of the relevant section of these Card and Wearable Terms. Changes to the reference exchange rate shall apply immediately, without prior notice.

9.4 Additional fees may apply when using an ATM, by the ATM provider.

10. Currency Exchange

10.1 When you register your Account, you have the option of choosing from a list of currencies, which will be the currency in which your Account will be denominated.

10.2 If you use your Card or Wearable to make a Transaction in a currency other than the currency of your Account, then this Transaction will be converted to the currency of your Account and you will receive an estimate of the converted amount at the time you make the Transaction, this may be less, or more, than the final amount deducted from your Account due to exchange rate fluctuations. We will use authorised rates applicable for such a Transaction. A foreign exchange fee will also apply (see the fees section on our Website for further details).

“Account balance” means the available amount of e-Money in your account issued by Us to You that has not yet been spent nor redeemed.

“ATM” means Automatic Teller Machine.

“Balance” means the value of funds that is held with the Card.

“Card” means MuchBetter Prepaid Debit Card.

“Card scheme” means Mastercard®.

“Contactless” means when Cardholder, while being personally present, authorizes a transaction without the requirement to enter the pin of the Card.

“Expiry of Card ” means the expiry date printed on the Card.

“E-Money” or  Electronic Money is electronically stored monetary value in your account.

“Merchant” means any commercial or business entity that accepts cards displaying the MasterCard® acceptance symbol as payment.  

“Payment” means any payment made using your Card or Wearable.

“PIN” means the personal identification number we issue to be used with your Card.

“QuickPay”, “MuchBetter”, “we”, “our”, “us” also means QUICKPAY LIMITED with its registered office located at the Black Church, St. Mary’s Place, Dublin 7, Ireland;

“Terms” means the Terms and Conditions which govern the use of the Card which you have been or will be issued with.

“Wearable” means a contactless payment device which is configured to be able to make payments using MuchBetter Service.

“Website” means www.muchbetter.com.

“Year” means 12-months period following the date when the card is issued to you and each subsequent 12- months period.

Unless otherwise indicated, capitalised terms not defined herein shall have the meanings ascribed to them in the Customer Agreement.

2. MuchBetter

2.1 QUICKPAY LIMITED (“QuickPay“, “MuchBetter”, “we”, “our”, “us”) is acting as an Electronic Money Distributor (EMD) for Sureswipe E.M.I. PLC (“Sureswipe”), a public limited liability company established in Cyprus, with registration number HE366500 and registered address at 18 Kyriakou Matsi, 1st Floor, Nicosia 1082, Cyprus and authorised as an Electronic Money Institution (EMI) with authorisation number 115.1.3.26, under the supervision of the Central Bank of Cyprus.

2.2 All Cards are issued by Paynovate SA incorporated in England and Wales and FCA regulated under reference number 900970 with its head office at Cantersteen 47, 1000 Brussels, Belgium.
